36.

(2) If the completion of the work is urgently necessary in

order to avoid danger to life or property, notice may be

dispensed with.

(1) In this section the expression "obstruction" includes

any dock, pier, wreck, vessel, timber, raft, or other thing

which, whether floating or fixed, in the opinion of the Port

Trust obstructs or is likely to obstruct the free and safe use

and navigation of the Port or has been constructed or placed

in the Port in contravention of Port by-laws.

(2) Obstructions may be removed at any time by the Port Trust

and, if their removal is impossible, they may be destroyed and

the owner of the obstruction or the person who placed or

permitted the obstruction to be in the Port shall be liable

to pay the expenses of removal or destruction unless the

obstruction was lawfully made.

(3) Any timber, wreck, or other property which may come into

the hands of the Port Trust in the course of the removal or

destruction of an obstruction may be retained by the Port

Trust until such time as the expenses are paid by the person

responsible to pay the same. Provided that if no owner be

known the property may be sold after the expiration of one

month and the proceeds retained by the Port Trust.

37. The Port Trust may, with the approval of the Governor in

Council, establish at any time a limit in the waters of the Port

under its jurisdiction beyond which construction from the shore may

not be extended and shall designate such limit as the "Port head-

line" for any part or the whole of the waters of the Colony.

38. When previously authorised by the Governor in Council, the

Port Trust may acquire, hold, possess, sell, dispose of, or lease,

real and personal property; and may either by itself or in co-

operation with others construct maintain and operate roads,

railways, vessels, plant, and equipment; and generally do such

things and exercise such powers as it deems necessary for the

efficient administration, management, and control of the Port,

harbour works, and other property under its jurisdiction.

39. (1) Whenever any works are to be executed under the direction
